General Terms and Conditions (GTC)

§ 1 Scope and Operator
These General Terms and Conditions apply to:
visiting and using the services of the Disco Volante restaurant,
using the website www.disco-volante.at,
and related services (e.g., newsletters).

(hereinafter referred to as "Disco Volante" or "Restaurant")
By entering the restaurant, using the website, or using its services, the guest or user agrees to these GTC.
§ 2 Restaurant Operations and House Rules
Disco Volante operates a restaurant at Gumpendorfer Straße 98, 1060 Vienna.
The restaurant exercises its unrestricted right of domicile.
Disco Volante reserves the right to refuse entry to guests or remove them from the premises, particularly if:
they behave disruptively, aggressively, or disrespectfully towards other guests or staff,
they are visibly intoxicated or impaired,
safety, hygiene, or legal regulations are not observed.
In these cases, there is no entitlement to service or compensation.
§ 3 Table Reservations and Seating
Reservations do not guarantee a specific table.
Tables are assigned by the restaurant, taking organizational requirements into account.
Disco Volante reserves the right to refuse or change reservations for operational reasons.
§ 4 Time Limits for Table Use
Tables are subject to time limits, especially during peak hours.
The usual length of stay depends on:
Time of day,
Numerous guests,
Size of the reservation.
Guests will be informed of the maximum table duration in advance or on-site, if necessary.
There is no entitlement to unlimited use of a table.
§ 5 No-Show Policy for Groups
For reservations of larger groups (generally 6 people or more), the following applies:
Free cancellation is possible up to 24 hours before the reservation time.
In the event of a no-show or failure to cancel in time, the person making the reservation is obligated to purchase a voucher worth EUR 20 for each person who does not appear.
This policy serves to compensate for the financial loss due to reserved capacity.
§ 6 Prices and Payment in the Restaurant
All prices are in euros and include VAT.
The prices displayed in the restaurant or on the website at the time of ordering apply.
Disco Volante reserves the right to change prices.
Accepted payment methods will be announced on-site.
§ 7 Website www.disco-volante.at
This website provides information about the restaurant, services, events, and news.
Disco Volante assumes no liability for:
continuous availability,
completeness or accuracy of all content.
Content may be changed or removed at any time.
§ 8 Newsletter
Disco Volante sends a newsletter no more than every two weeks.
The newsletter is only sent to subscribers who have actively registered.
You can unsubscribe at any time via the link provided in the newsletter.
§ 9 Data Protection
Personal data is processed in accordance with the privacy policy on www.disco-volante.at.
This website is operated via the Wix.com platform.
Personal data is stored on Wix.com's servers.
Data is only shared with third parties to the extent permitted or required by law.
Disclosure to third parties is not permitted or required by law.
§ 10 Liability
Disco Volante is liable only for damages resulting from intent or gross negligence.
No liability is assumed for guests' personal belongings.
No liability is assumed for the content of external, linked websites.
§ 11 Abusive Behavior
Disrespectful, discriminatory, or harassing behavior towards staff or other guests will not be tolerated.
In such cases, a ban from the premises may be issued.
§ 12 Final Provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction is Vienna, to the extent legally permissible.
Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
Disco Volante reserves the right to amend these Terms and Conditions at any time. The current version at www.disco-volante.at applies.
